Terms and Conditions of Use
The consultation of this digital menu, provided through the MenuLampo technology service, is subject to the following informational conditions and conditions of use.
1. Technological role of the provider
The MenuLampo platform is designed, maintained and licensed for use by RAD LAB di Riccardo M'Rad, P.IVA 11078251219, with registered office at Via Chiummano n. 47, 80072 Barano d'Ischia (NA) (hereinafter the "Provider"). The Provider acts exclusively as the operator of the technological infrastructure (Software-as-a-Service). The Provider does not verify the substantive accuracy of the menu's contents (descriptions, images, prices, ingredients, allergens, availability), which are entered independently and under the exclusive responsibility of the owner of the restaurant business (hereinafter the "Restaurateur"). Any automated processing or translation tools operate in a purely technical manner and do not constitute a substantive review of the contents. The Provider remains responsible, within the limits of the law, for the correct technical functioning of the service.
2. Accuracy of commercial contents
Prices, offers, opening hours and availability of dishes are provided by the Restaurateur under their own exclusive responsibility and do not constitute a binding offer to the public on the part of the Provider. Temporary discrepancies may occur between what is displayed in the digital menu and what is actually applied or available on the premises. What the Restaurant's staff communicates at the time of ordering shall prevail in all cases. The Provider disclaims any liability for such discrepancies.
3. Legal and health warning on allergens (Regulation (EU) No 1169/2011 (Food Information to Consumers) and Legislative Decree no. 231/2017)
The menu includes indications relating to allergens and dietary regimes, and may include, where configured, consultation filters, for the purpose of informational assistance. Such tools do not replace the allergen information that the Restaurateur is required to provide by law. The associations between a dish and an allergen derive solely from a self-declaration by the Restaurateur, who is the sole party responsible pursuant to Regulation (EU) No 1169/2011 (Food Information to Consumers) and Legislative Decree no. 231/2017. Allergens are managed by means of the 14 categories provided for by Regulation (EU) No 1169/2011, with predefined multilingual labels and not by means of automatic translation of the texts. The Provider does not take part in the preparation of the food, has no knowledge of the ingredients used and cannot guarantee the absence of cross-contamination in the kitchen.
Warning for users with allergies or intolerances: anyone affected by allergies, food intolerances or other conditions requiring dietary attention (e.g. coeliac disease) is required not to rely exclusively on the indications of the digital menu and to always inform the dining-room staff before ordering, requesting consultation of the mandatory allergen information made available by the premises. The Provider is not liable for the accuracy of the allergen information entered by the Restaurateur, nor for adverse reactions arising from such information or from the preparation of the food, without prejudice to its own liability, within the limits of the law, for the correct technical functioning of the service.
4. Intellectual property
The trademarks, logos, photographs and texts of the menu belong to the Restaurateur or to their respective owners. The platform, the software and the graphic design of the MenuLampo system belong to the Provider. Any unauthorised reproduction is prohibited.
5. Limitation of liability of the Provider
The Provider undertakes to ensure the best possible technical continuity of the service, but does not guarantee the absolute absence of interruptions, malfunctions or delays in updates due to technical causes, maintenance or events not attributable to it. Within the limits permitted by law and save in cases of wilful misconduct or gross negligence, the Provider is not liable for damages arising from the use of, or the inability to use, the digital menu. Nothing in these Terms excludes or limits the Provider's liability for death or personal injury, nor any other liability that cannot be excluded or limited under the law.
6. Governing law and jurisdiction
These Terms are governed by Italian law. The mandatory protections in favour of consumers remain unaffected: for disputes with a consumer, jurisdiction lies, on a mandatory basis, with the courts of the consumer's place of residence or elected domicile (Art. 66-bis of Legislative Decree no. 206/2005 (Italian Consumer Code)). For disputes between businesses only, or in any event with parties not qualifiable as consumers, relating to the technical functioning of the service, the Courts of Naples are indicated as having jurisdiction, save as otherwise agreed in writing; such clause is effective only if specifically approved in writing (Art. 1341(2) of the Italian Civil Code). Any complaint relating to the quality of the food, table service or the bill must in the first instance be directed to the management of the Restaurant, without prejudice to any other legal protection.
7. Amendments
These Terms may be updated in the event of technical or regulatory changes. Last updated: 22/06/2026 14:15 CEST.
